BALI VILLA HOLIDAYS TERMS AND CONDITIONS
- ACCOMMODATION PRICING
All prices are subject to availability and confirmation and can be withdrawn or varied without notice. Prices are quoted in UK Pounds and may be subject to exchange rate fluctuations beyond our control until paid in full. All deposits are required to be paid before bookings will be processed. Full payment is required minimum 30 days before arrival date – this may be earlier for bookings during peak or high season periods or subject to the individual policies of the accommodation provider. For bookings made inside of 30 days prior to arrival, then full payment will be required at the time of booking.
Bank Transfers – All bank fees (including Bali Villa Holidays bank correspondence / beneficiary / receiving fees) are to be included in the total amount transferred. Any shortfall in the total rental amount received from the rental amount due will be due and payable prior to arrival. NOTE: You will need to instruct your sending bank to ensure the full amount transferred is guaranteed to Bali Villa Holidays receiving bank.
Credit Card Transactions – Credit Card surcharges apply when paying by credit card. Visa / Mastercard 3%. Amex cards are not accepted. If for any reason any accommodation provider is unable to provide the accommodation for which you have contracted, your remedy lies against the provider, and not against Bali Villa Holidays. In the event that your payment has been made to Bali Villa Holidays by credit card, you agree that you will not seek to charge back your payment to Bali Villa Holidays.
Certain taxes are mandatory in various countries and regions. All taxes are subject to change without notice.
Once the payment of the deposit is receipted by Bali Villa Holidays, this then constitutes confirmation of the Villa Rental and acceptance by the guest of these booking Terms & Conditions. All deposits are non refundable. Cancellations within 60 days may be fully non refundable. Please ensure you have the relevant travel insurance that may cover you in the case of any unforeseen circumstances such as illness or accidents. Some cancellations may be partly refundable, but cancellation charges will apply. Bali Villa Holidays is unable to provide any refund to you until we receive the funds from the relevant accommodation provider.
- TRAVEL INSURANCE
We strongly recommend that you take out comprehensive travel insurance at the time of booking, to protect you and all those accompanying you for the full time of your visit against illness, including evacuation, injury, death, loss of baggage and personal items, theft, cancellation and other travel contingencies.
- NUMBERS IN PARTY AND SUITABILITY
The number of persons occupying a property must not exceed the maximum number stated in the property description unless by prior arrangement. Everyone occupying the property must be listed in the booking form, including small children. The accommodation cannot be shared or sub-let and only the persons shown in the booking form are permitted to stay in the property. Persons under the age of 18 are not accepted as guests unless accompanied by parents or responsible adults. BVH reserves the right to refuse any booking. Failure to comply will render the booking void and no compensation will be paid.
- CODE OF CONDUCT
The actions of all occupants of the property shall not interfere with the enjoyment of other holidaymakers or residents. Please do not use the pool after 10.00pm and before 07.00am. Please reduce music and other sounds especially in the outside area to a minimum during 10.00pm and 7.00am. If there is a Police or Banjar report, the guest is responsible to pay any penalties. The Villa owner and Bali Villa Holidays reserve the right to terminate the agreement immediately and forthwith. The Villa owner and Bali Villa Holidays are not responsible for any costs occurring nor shall we pay any compensation due to a break of the Code of Conduct.
- EVENT AND PARTY
The majority of villas have rules governing their usage for events and parties. A surcharge normally equivalent to one night’s rental price is applicable, in addition to a local community or ‘Banjar’ fee. Special permissions from Bali Villa Holidays must be obtained for functions where the number of people in attendance exceeds 150% of the capacity of the villa. Please be aware that the majority of villa owners will not accept a booking involving events/parties without prior confirmation that an event coordinator has been employed. If you are planning to hold an event- such as a wedding or any large congregation of people at the villa- kindly bring this to the Bali Villa Holidays attention as soon as possible. Any event/party approval is at the sole discretion of The Villa Owner and Bali Villa Holidays.
Bali Villa Holidays acts as an agent only. We sell various villas accommodation on behalf of villa owners and villa management companies. Bali Villa Holidays obligation is to make villa or other type of accommodation bookings on your behalf and to arrange relevant contracts between you and the accommodation provider. Bali Villa Holidays has no responsibility for these services nor do we make any warranty or representation regarding the standard of the accommodation. All bookings are made subject to the terms and conditions and limitations of liability imposed by these accommodation providers.
If for any reason, any accommodation provider is unable to provide the accommodation for which you have contracted your remedy lies against the provider and not Bali Villa Holidays.
- DAMAGES, BREAKAGES AND LOSSES
Guests are responsible for looking after the property, leaving it in good order and clean condition. Guests also undertake to pay for damages, breakages or losses they may be responsible for during the period of their stay. Bali Villa Holidays reserves the right to reclaim the hired property if the hirer, members of the guest party or guest visitors cause excessive damage or mess.
Please Note: It is the policy of BVH that all guests sign a credit card authorization form at check-in to cover the possible cost of any damages that may occur to the rented premises due to the occupancy of the premises by the guest. All guests will also be required to sign a “Waiver of Liability” form at check-in.
The owner of the Villa and Bali Villa Holidays accept no responsibility whatsoever for death, personal injury, accidents, loss or damage to person or personal belongings however caused. The use of all accommodations’ and amenities including the pool is entirely at the user’s own risk. Children must be supervised by responsible adults all the time, especially when using the pool. Please note that local staffs (housekeepers, nannies, gardeners) are normally not able to swim. Glass items are not permitted within the pool area. The owner of the Villa and Bali Villa Holidays cannot accept any liability for loss of rental time due to a travel problem, flight delays or cancellations, industrials disputes or any event outside our control, including any form of Force Majeure. The owner of the Villa and Bali Villa Holidays cannot accept any responsibility for sudden failure of villa equipment but will take immediate reasonable action to rectify any such failure upon notification by the guest.
Sometimes in Bali, there are electricity black-outs and not all villas accommodation are equipped with back-up generators. The Villa owner and Bali Villa Holidays cannot be responsible for those situations and uncontrollable situations related to building/construction noise, party and event inconveniences and any other annoyances.
All of our villas are non-smoking. Ashtrays are provided in the outside living room area or terrace for guest wishing to smoke. For the safety and comfort of all guests, smoking is not permitted inside the villa. Pets may be accepted at some Villa Accommodation. Please confirm with Bali Villa Holidays for the individual policies of the villa accommodation you are considering. Pets will not be accepted without first written approval from the villa accommodation provider and Bali Villa Holidays.
- USE OF THE POOL
The guests should never intervene personally in the pools machinery. The pool is cleaned and chemically balanced regularly by the staff for your safety and comfort. However on rare occasions, it might be necessary to apply additional chemicals to the pool to maintain safety and correct chemical levels. Should this occur during your stay, it may be necessary to leave the pool area for a short time.
- OWNERS ACCESS
The Villa Owner, Villa Manager and Bali Villa Holidays shall be allowed to inspect the property at anytime during your stay. Should access be required we will always attempt to contact you and schedule the visit at the most convenient time for you. However, access must be always granted for security reasons and emergency repairs.
- PASSPORTS & VISAS
It is your responsibility to ensure that you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities for the Country and/or region you will be visiting. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility
All travellers must have a valid passport for international travel and must have an expiration date not less than 6 months prior to entry
- POSSIBLE CURRENCY EXCHANGE RATE FLUCTUATION THROUGH CREDIT CARD BILLING
The Indonesian Rupiah has been experiencing considerable fluctuation against foreign currencies in the past few years.
We would like to make you aware that if you settle your account by credit card, the amount you are billed by your credit card company may differ substantially from the amount you sign on. Indonesian banking regulations dictate that we raise all charges in Rupiah, whether it is originally quoted in UK Pounds or others currencies. If the charge originated in UK Pounds, we apply the daily mid Rupiah exchange rate that is obtained from our bank. This figure can be checked with Bali Villa Holidays at any time. Please note that as per bank regulations, we also receive funds from credit card companies in Rupiah and make no financial benefits from the currency fluctuation. Your credit card charge passes through many banks, each perhaps having different exchange rates and we cannot predict the amount you may be billed in the currency your credit card was issued. BVH cannot accept any responsibility for the loss through currency fluctuation. To prevent any risk of exchange rate fluctuations you may wish to settle your account by Bank Transfer in UK Pounds, please be informed that banking fees apply. For any cash payment with UK bank notes during your stay or if you intend to exchange them into Rupiah at a local money exchanger, kindly be informed that they should be crisp and free of marks & tears. UK notes must be issued after year 2006, older ones are not accepted.
